REGISTRATION/PARTICIPATION & REFUND POLICY

There are no refunds, or credits will be given after the starting date of a session or any program. No refunds or credits are given for unused classes/camps/programs due to personal reasons. No refunds, credits or make ups are given for classes/programs/camps cancelled due to circumstances that are out of Kids Language Art's control such as snow days, natural disasters, pandemic or unforeseen events that may affect normal operating status, mandatory closures as required by state or federal government agencies or state school system.  For Summer Camps, cancelations will only be accepted until April 1st.

Refunds or credits will not be issued if not sufficient notice is given, or after the starting date of the program. There is a cancellation fee of 5% from the total amount being refunded for cancellations eligible for refunds (made before before April 1 for Summer Camps). 

Any balances of partial payments or deposits are due at least 48 hours before the first class/camp begins for the entire amount remaining. Parents will be billed and are expected to pay for all services indicated on the registration whether or not the service has been used. Refunds will be issued for cancelations received in writing before April 1 for Summer Camps, minus the 5% cancellation fee. Full refunds are only issued if a program is canceled by KLA. No refunds for Summer Camp fees  will be issued for any cancelations after April 1st. 

For Summer Camps, cancelations will only be accepted until April 1st.  Transfers between Summer programs are possible at all times provided space is available.

In case of late late registrations, your tuition will be prorated if space is available.

All participants should be registered prior to the class. Any payment in the form of a check or in store credit card payment, needs to be accompanied with a printable registration form and needs to include all contact information, and a signed waiver.

Any claim regarding program registration/payment/product that is submitted after 60 days from the starting date will be considered overdue and will not be refunded or credited.

All participants must be fully enrolled in the given program prior to rendering the service: Registration must be filed and payment and liability waiver must be received by KLA. If a participant is not included in the class roster, and a proof of registration is not available the player may not be allowed to participate in the program that day.

Withdrawal, Substitution & Refunds:

There are no refunds, or credits will be given after the starting date of a session or any program. No refunds or credits are given for unused classes/camps/programs due to personal reasons. No refunds or refunds are given for classes/programs/camps cancelled due to circumstances that are out of Kids Language Art's control such as snow days, natural disasters, unforeseen events that may affect normal operating status, mandatory closures as required by state or federal government agencies or state school system.

In order to withdraw your child from a class before the starting date, please contact KLA at least 21 days before the beginning of the class.Registrations cancelled in less than 21 days prior, will be eligible for a program credit towards the next upcoming season only. No credits will be issued for Summer/Spring/Winter Camps and After School programs cancelled in less than 30 days. 

MONTHLY TUITION PROGRAMS REQUIRE A MINIMUM OF 30-DAY, WRITTEN NOTICE FOR WITHDRAWALS/CANCELLATIONS OR CHANGES OF SCHEDULE. NO REFUNDS WILL BE GIVEN FOR UNUSED DAYS/WEEKS. AFTER-SCHOOL PROGRAMS TUITION SCHEDULE IS  AUGUST-JUNE: AUGUST BEING PRORATED FOR HALF OF THE TUTION AND SEPTEMBER-JUNE AT FULL TUITION.

Please notify Kids Language Art  in writing, at least 30 days prior to end the enrollment in the program and to stop any future payments. I understand that refunds are not available for late cancellation.

For security/liability reasons, only fully registered participants are allowed to participate and interact with other children while in the class. Please note that apart from our liability policy carrier, all facilities have strict requirement in terms of admission of any individuals who are not listed on the provided roster. This assures safety of all registered families.

Siblings are not allowed in the class. Registered participants deserve full attention of the teacher and safe environment. For that reason, any of KLA Staff members is asked to reinforce that rule to assure safety of our children and quality of the program.

If you would like to invite a friend with non-playing child, please let our office know, and we will make a note to the roster for easy entry. Friends who are not registered in the program, and would like to enroll or register for a try-out class, should register online before coming to the class, and have a proof of their registration ready to present to the teacher.

Change of class

Parents must inquire first with KLA if there is a possibility of switching to another class.

In case of switching to another proposed class, you agree to transfer your registration and your registration agreement to that class, therefore, no refunds will be issued.

Make Ups 

Make up classes are not available for personal cancellations of regularly scheduled class, however you may attend any other class in lieu of make up . KLA will attempt to make up weather-related cancellations by adding a class within the time frame of the given session, or offer spots in other classes in lieu of make up. Classes can not be carried over to the next month/tuition.

Late Registration/Over the phone transactions and registrations

In order to participate in any of KLA programs, each child is required to be fully registered (have the online registration/liability form on file, and proof of payment).

All over the phone transactions are processed ONLY if the online registration (that includes liability waiver) is submitted.

If we do not have your complete registration information prior to the starting date, we will not allow your child on the field. There will be no refunds or prorates for the remaining sessions.

AFTER-SCHOOL PROGRAM REGISTRATION POLICY:

PROGRAMS REQUIRE A MINIMUM OF 30-DAY, WRITTEN NOTICE FOR WITHDRAWALS/CANCELLATIONS OR CHANGES OF SCHEDULE. NO REFUNDS WILL BE GIVEN FOR UNUSED DAYS/WEEKS. AFTER-SCHOOL PROGRAMS TUITION SCHEDULE IS AUGUST-JUNE: AUGUST BEING PRORATED FOR HALF OF THE TUTION AND SEPTEMBER-JUNE AT FULL TUITION. I understand my first payment and enrollment in the program will be done by me as a parent/guardian, and then automatically each month thereafter. I will contact Kids Language Art if I need to alter my payment method or date of payment. I will notify Kids Language Art at least 30 days prior to end the enrollment/requesting a withdrawal in writing from the program and stop any future payments. I understand that my first tuition payment done at registration will be applied to the last month of my program enrollment. I understand that refunds are not available for late cancellation.


All students registered for after-school program must be elementary school age students, grades K-6.

After school program operates Monday-Friday, with choice of attending one or more days, with choice of following sessions within the time of 4PM-6PM, depending on the time of arrival or with pick up from schools in network. Students receive between one, or one and a half hours of language immersion instruction time daily with highly qualified, native speakers language instructors, not to exceed six hours weekly when school is in session, and no more than twelve hours weekly when school is not in session. Days of attendance may be altered based on availability in the given program. Missed days/make ups may be arranged if space is available. No refunds or credits can be issued for missed classes. 

Parent Release

I understand that KLA expects every parent to read, and agree to all the terms, prior to registration. This registration is a verification of my agreement to KLA terms. Although, all efforts are being made to provide my child with safe environment, I understand that there is a risk of accident. If necessary, I authorize KLA staff to undertake first aid procedures. I further understand that KLA directors and employees assume no responsibility, and will be not liable for any kind of injury, illness, or accident resulting in medical, dental, or other expenses. It is also my responsibility to have my child picked up promptly at the end of the scheduled class. I’ll let the teacher know if anyone else than myself will be picking up my child.

I also give Kids Language Art, LLC permission to use my child’s name and or picture in promotion of the camp/program in printed media and another forms of advertisement. I fully renounce all claims upon Kids Language Art for reimbursement for the use of this material. I, on behalf of myself, my executors, administrators, heirs, next of kin, and successors, hereby covenant to hold harmless and indemnify Kids Language Art, LLC and all its officers, departments, agencies, and employees from any and all claims, lessees, damages, injuries, fines, penalties, and costs (including court costs and attorney’s fees), charges liabilities, or exposures, however caused, resulting from or arising out of or in any way connected to my or my family’s participation in any KLA program/services.

I have read and understand both this Hold Harmless Agreement as well as the KLA Registration Policy, Cancellation, and by my signature I agree to its terms.

KIDS LANGUAGE ART WAIVER AND RELEASE OF LIABILITY AND NAME AND LIKENESS

A PARENT, LEGAL GUARDIAN, OR EMPOWERED REPRESENTATIVE OF EACH MINOR CHILD(REN) REGISTERING TO ATTEND KIDS LANGUAGE ART, LLC CAMP/PROGRAM MUST AGREE TO THE TERMS OF THIS WAIVER AND RELEASE OF LIABILITY AND NAME AND LIKENESS PRIOR TO THE CHILD(REN) PARTICIPATING IN THE PROGRAM/CAMP.

I, on behalf of myself and my Child(ren), hereby acknowledge and agree that:

Name and Likeness Release:
 In consideration for my child(ren) being permitted to participate in the Camp, I hereby grant permission to Kids Language Art, LLC, and each of its affiliated or subsidiary companies, their successors, agents, and assigns (“KLA”) to utilize my child(ren)’s name, voice, and likeness (including, but not limited to, photographs and any video/audio recording of my child(ren)’s appearance at the Camp) in any and all manner and media, now known or hereafter developed, throughout the universe in perpetuity without limitation and without additional compensation or consideration, notification, or permission, unless prohibited by applicable law. I hereby waive any right that I or my child(ren) may have to inspect or approve any finished product (including, but not limited to, any camp blog, brochures, videos, slide shows, web sites, and/or other materials) or any advertising copy that may be used in connection therewith or the use to which it is applied. I hereby warrant that I have the right to make this release on behalf of my child(ren) and that my granting this waiver and release and the rights conveyed thereby will not infringe upon the rights of any third party. I hereby assign all rights, title, and interest my child(ren) or I may have in any and all media now known or hereafter developed in which any or all of my child(ren)’s appearance, name, voice, and/or likeness have been captured in connection with the Camp to Kids Language Art, LLC, along with full rights of assignability. I understand and agree that any photographs and/or video/audio recordings I make of my child(ren) at the Camp shall be used solely for my and his/her/their private, non-commercial use, and that absolutely no sale, transmission, distribution, or commercial use of any such photographs and/or video/audio recordings or descriptions are permitted.

 

Physical Condition:
 On behalf of my child(ren), I accept and assume any and all risks associated with his/her/their attendance and participation in the Camp or Program and all related activities. I understand that my child(ren) should not attend the Camp/Program if he/she/they are not in a healthy condition. Furthermore, I do hereby verify that my child(ren), to the best of my knowledge, is free from contagious disease, is fully immunized, and is able to participate in the Camp. Therefore, I hereby confirm that my child(ren): (i) has no psychiatric, medical, and/or physical condition or history which would prevent him/her/them from participating in the Camp and/or endanger himself/herself/themselves or others at the Camp; (ii) has not been instructed by any physician to refrain from participating in the Camp; and (iii) is physically fit and able to participate in the Camp.

Medical Treatment: 
In connection with any injury my child(ren) may sustain or illness or other medical conditions my child(ren) may experience during his/her/their participation in or attendance at the Camp, I authorize any emergency first aid, medication, medical treatment, or surgery deemed necessary by the attending medical personnel if I am not able to act on my child(ren)’s behalf. In the event that I cannot be contacted in the event of an emergency, I further hereby grant Kids Language Art, LLC, permission to administer immediate treatment and/or take my child(ren) to a hospital emergency room via ambulance/emergency vehicle. I further authorize the attending medical personnel to execute on my child(ren)’s behalf any permission forms, consents, or other appropriate documents relating to medical attention. I agree to assume all liability for any expenses incurred in such an emergency (transportation, hospitalization, x-rays, etc.). I also understand and agree that Kids Language Art, LLC, t will notify me if my child(ren) becomes ill during camp hours, and I will arrange to have my child(ren) picked up immediately from Camp. Further, I waive and release Kids Language Art, LLC, and its owners, officer, directors, employees, agents and independent contractors from any and all liability for personal injuries, illness, loss, or damage to property.

Program/Camp Policies and Rules: 
I understand and agree that my child(ren) must abide by the Camp policies and rules and the instructions of the Camp organizers, employees, staff, counselors, and volunteers at all times, and that my child(ren)’s failure to do so will result in his/her/their immediate dismissal from the Camp. Some of these policies, rules, and instructions are written and some are at the sole discretion of the Camp organizers, employees, staff, counselors, and volunteers; however, it is understood that all policies, rules, and instructions seek at all times to ensure the overall safety of the Camp and each of its participants.
 Furthermore, should my child(ren) fail to behave in an appropriate manner, intentionally harm another participant, exhibit signs of illness, or violate any Camp policy and rule, I shall promptly retrieve my child(ren) when contacted by Kids Language Art, LLC, to do so, or, if I am unable to do so, notify Kids Language Art, LLC, of the person retrieving my child(ren) on my behalf. I acknowledge and agree that no part of the tuition paid will be refunded to me should my child(ren) be dismissed from the Camp. I also understand and agree that no reduction or prorate in the tuition will be made for late arrivals, early departures, vacations, illness, or injury.

Assumption of Risk:
I understand that my child(ren), and each participant in the Program/Camp, will be engaging in activities that may involve the risk of serious personal injury, illness, permanent disability, dismemberment, and death, and that also involve the risk of severe economic and property loss and damage. I understand that these risks may result from the actions, negligence, and failure to act of my child(ren) and others (including, but not limited to, other participants in Program/Camp, and the organizers, employees, staff, counselors, and volunteers, if any, of the Program) and the condition of any real or personal property, facilities, or equipment used during the Program. I also understand that there may be risks involved in any and all activities which my child(ren) may participate which are not known to me, my child(ren), Kids Language Art, LLC, or its organizers, directors, members, employees, staff, counselors, and volunteers, if any, and may not be foreseen or reasonably foreseeable by any of the foregoing entities or persons at this time or at the time of the Program/Camp.
For my child(ren) at program, these activities and associated risks may include time in the pool and transportation via motorized vehicle (shuttle, coach, and/or school bus) to and from camp and between different segments of the Program during camp hours. Permission is granted to Kids Language Art, LLC, to transport my child(ren) via motorized vehicle to and from the Program during camp hours and between different segments of the Kids Language Art, LLC location/facility and any outside facilities used by Kids Language Art LLC during the Program/Camp.
In consideration for my child(ren) being permitted to participate in the Program/Camp, I, on behalf of my child(ren), assume all of the foregoing risks, including, but not limited to, the risk of any negligence by other Camp participants or by Kids Language Art, LLC and its respective owners, partners, directors, officers, employees, and agents, and the risk of injury caused by the condition of any real or personal property, facilities, or equipment used during the Program/Camp, and accept personal responsibility for any injury (including, but not limited to, personal injury, disability, dismemberment, and death), illness, damage, loss, claim, liability, or expense (including reasonable attorneys’ and professionals’ fees), of any kind or nature, that my child(ren) or I may suffer arising out of or in any way connected with the Program/Camp or my child(ren)’s participation in or attendance at the Program/Camp.

Furthermore, I, on behalf of my child(ren) agree to indemnify and hold harmless Kids Language Art, LLC and its owners, partners, directors, officers, employees, and agents from any claim that I might have arising out of my child(ren)’s participation in, transportation by, or involvement with the Camp. I understand that my child(ren) are fully responsible for complying with all rules and regulations of the Program/Camp and any motorized vehicle service and that Kids Language Art, LLC reserves the right to cancel my child(ren)’s participation in the Camp or motorized vehicle service at any time.

I further understand that while Kids Language Art, LLC will make every effort to minimize lost items at the Program/Camp or on the motorized vehicle, Kids Language Art, LLC is not responsible for any property left at the Program/Camp or on the motorized vehicle. I also understand that there will be specific and non-negotiable times for the departure and arrival of some Kids Language Art, LLC transportation, and Kids Language Art, LLC has the right to cancel my child(ren)’s participation in the motorized vehicle if these departure and arrival times are not respected.
I also agree that no general or limited partner, shareholder, director, officer, member, beneficiary, trustee, manager, other controlling person, investor, employee, attorney, agent, or independent contractor of Kids Language Art, LLC (each an “Exculpated Person”) shall be personally liable for any obligation or liability of such party in connection with the Program/Camp, and all obligations and liabilities of such party in connection with the Program/Camp are enforceable solely against such party and such party’s assets, and not against any Exculpated Person or the assets of any Exculpated Person.

Liability Release and Indemnity Agreement:
 I, on behalf of my child(ren), hereby release and forever discharge and agree to indemnify and save and hold harmless Kids Language Art, LLC, Camp facility partners, the respective owners (direct and indirect) and each of their respective parents and affiliated and subsidiary companies, volunteers associated or affiliated with the Program/Camp, and each of the aforementioned respective officials, owners, partners, directors, officers, employees and agents, and the other participants in the Program/Camp (each such entity or individual being referred to as a “Released Party”), of and from any and all injuries (including personal injury, disability, dismemberment, and death), illness losses, damages, claims, liabilities, or expenses of any kind or nature (and whether accruing to me, my child(ren), my heirs, or my personal representatives) that are caused or alleged to be caused in whole or in part by the action, negligence, or failure to act by any Released Party or condition of any real or personal property, facility, or equipment of any Released Party, and that arise out of or are in any way connected with any aspect of the Program/Camp or my child(ren)’s participation therein or attendance thereat.

 

I acknowledge that, in the event of any breach by Kids Language Art, LLC ,or any third party, the damage, if any, caused me or my child(ren) thereby will not be irreparable or otherwise sufficient to entitle me or him/her/them to seek injunctive or other equitable relief, and my child(ren) and I will be strictly limited to the right, if any, to recover damages in an action at law. Neither my child(ren) nor I will have either the right to rescind or terminate this waiver and release or any of Kids Language Art’s, rights hereunder, or the right to enjoin the production, exhibition, or other exploitation of my child(ren)’s name, voice, and likeness, or any subsidiary or allied rights with respect thereto.

Severability of Provisions: 
I have carefully read the entirety of this waiver and release and agree to all its terms and conditions. I represent that I am the parent, legal guardian or empowered representative of the minor child(ren) in the registration form with the authority to give this waiver and release, and I hereby agree that both my child(ren) and I shall be bound hereby. I agree that the foregoing terms and conditions are intended to be as broad and inclusive as is permitted by law, and any terms and conditions set forth herein found by a court to be void or unenforceable shall not affect the validity or enforceability of any other terms and conditions. This waiver and release will inure to the benefit of and will be binding upon both my, my child(ren)’s, Kids Language Art’s respective affiliates, successors, licensees, assigns, heirs, and representatives.

Conclusion: 
I have carefully read the entirety of this waiver and release and agree to all its terms and conditions. Knowing all of these facts and in consideration for your accepting my child(ren)’s enrollment form/online registration and for being allowed to participate in the Camp/Program, I, for myself, my child(ren) attending the camp, and anyone else who may claim on me or my child(ren)’s behalf (“I”) hereby agree that neither Kids Language Art, LLC and/or the schools or facilities that host the Program/Camp, are responsible for accidents, injuries, and/or medical or dental expenses arising from my child(ren)’s participation at the Program/Camp and, accordingly, I covenant not to file suit against or otherwise sue Kids Language Art, LLC, and waive, release, and discharge Kids Language Art, LLC and the various schools or facilities that host the Camp/Program, and anyone working on their behalf from any and all claims of liability or expenses of any kind or nature whatsoever arising out of or relating to my child(ren)’s participation in the Camp/Program.

* I affirm that by checking the box at the time of registration of my child(ren), I am executing the legally binding equivalent of my handwritten signature confirming that I understand, agree to, and intend to be bound by the above Terms of Acceptance.
